[BoulderCouncilHotline] Revised Ordinance for the Landmark Designation of the Boulder-Dushanbe Teahouse

Dear Council Members,

I would like to call attention to a change in the designation ordinance for the Boulder-Dushanbe Teahouse, which you will consider at your meeting tomorrow night. The ordinance language was revised between the 1st and 2nd readings to address concerns from the ditch companies.

On Oct. 6, 2020, the City Council received a letter from Scott Holwick on behalf of the Boulder and Left Hand Irrigation Company, the Boulder and White Rock Ditch and Reservoir Company and the North Boulder Farmers Ditch Company (Attachment C). The letter stated that the represented ditch companies oppose the ordinance as drafted.

Since Oct. 6, staff from Planning & Development Services, Public Works, Open Space and Mountain Parks and the City Attorney's Office have met with Mr. Holwick to draft language in the ordinance that would address the ditch companies' concerns and state that a Landmark Alteration Certificate shall not be required for the operation or maintenance of the ditch, including any necessary repairs or improvements, within the ditch easement. The revised language has been added as Section 5 in Ordinance 8431.

The revised language has been added as Section 5 in Ordinance 8431 (Attachment A). Staff has communicated the proposed change to the applicant, the Friends of the Boulder-Dushanbe Teahouse, and the Landmarks Board. It is anticipated that the Friends of the Boulder-Dushanbe Teahouse will submit a letter with their response to the revised ordinance by Oct. 20.

Because the ordinance language has changed since 1st Reading, a 3rd Reading will be required, and could be scheduled on the consent agenda of Council's next meeting.
