[BoulderCouncilHotline] Governor Polis’s executive order

Dear Hotline followers and colleagues,

On July 12, 2020, Governor Polis issued Executive Order D 2020 134<https://www.colorado.gov/governor/sites/default/files/inline-files/D%202020%20134%20Evictions.pdf>, which includes the following language: “I strongly encourage all municipalities and other local jurisdictions that place limits on the number of unrelated persons who can live in a single household or that prohibit group or boarding houses to suspend or eliminate those restrictions to enable homeowners to rent or give a room or rooms to those in need of housing.”

This executive order recognizes the brutal realities that many in our state are already facing, and which many more are likely to face in the near future, including within our community. Specifically, in light of evictions that loom, even more people are in danger of becoming homeless — and increasing legal living options offers a lifeline.

I would like to understand the steps Boulder City Council would need to take if we wanted to suspend, alter, or eliminate our occupancy restrictions in keeping with Governor Polis’s suggestion.

I also will note that we have a ballot initiative under consideration that gets at this issue. I don’t believe it is my place to weigh in on the merits of the 2 ballot measures that City Council will be discussing on 7/21<x-apple-data-detectors://1> (rather, my position is that I should consider whether to effectuate direct democracy in a year that has thrown a defeating number of curveballs at petitioners); but for anyone who is considering the merits, I thought Governor Polis’s recommendation may be helpful / relevant background information.
