[BoulderCouncilHotline] 4th reading of Ordinance 8256 - ADUs - Proposed amendments in response to CAC feedback

Dear Council Members,

In response to a questions and comments at yesterday's Council Agenda Committee meeting regarding the 4th reading of the Ordinance 8256 (amending standards for accessory units), I have drafted proposed amendments to the 4th reading Ordinance that Council may consider adopting at tonight's meeting.  The proposed changes also incorporate a couple of suggestions made by Ira Barron in an email sent to Council on Sunday.

The proposed changes in the attached document would:

  1.  Clarify that modifications to approved accessory units are not subject to saturation limitations;
  2.  Further clarify the floor area limitations for detached accessory units; and
  3.  Eliminate changes to the variance process under Section 9-2-3(j), B.R.C. 1981.  On 3rd reading, Council had deleted the word "paved" under the parking requirement of this variance process.  However, following adoption of Ordinance 8256, the variance process of 9-2-3(j) will no longer apply to accessory units.  Staff recommends that changes to Section 9-2-3(j) be considered as part of a comprehensive review of the parking standards.
I am attaching the proposed amendments to the 4th reading Ordinance to this email.  A copy of these proposed amendments will also be provided to you on the dais at tonight's meeting.

Please also note that if Ordinance 8256 is finally adopted on November 8, the effective date of the ordinance would be December 8, 2018.  In one place, the memorandum in the agenda packet inadvertently refers to the effective date as November 29.
