I have the following questions regarding what was agenda item 3I at our last Council meeting regarding the ordinance for the 9th and Canyon Urban Renewal Plan:
 
1)     
If the project is built out per the concept plan that was presented in January at our study session, what percentage of the total floor area developed under this BURA Development Plan will be for civic use?  How is this expected to compare
 to the 20% envisioned in the 1995 agreement?
2)     
Is it correct to expect that nearly 22,000 square feet will be available for civic use if this concept plan is built?
3)     
What is the expected FAR of the new development if the concept plan is built?  What is the expected FAR of the entire BURA Development Plan if the concept plan is built?
4)     
In the LOI, why is the commitment to the rooftop deck space so weak ‘(
 and possibly a rooftop deck that may be used by the community as well.’)?  I would like to see that commitment be much more firm.  This applies to sections 2 and
 3e of the LOI.
5)     
Who will determine the qualified caterers to the space?  How will that list be maintained and evolved over time?  What will the process to apply for qualification look like?
6)     
A comment: the management agreement will be the document that really makes or breaks the civic usefulness of this space.  While I do believe it should be cost-neutral to the St. Julien, it should also not be a major profit center.  How
 early in advance civic users need to book the space, relative to the St. Julien, should be worked out and agreed upon early in the process, perhaps even before passing this ordinance.  That would provide clarity to the community about priority of uses in this
 new space.
7)     
I think that actual space maintenance, cleaning, and utilities should be accounted and recorded separately from the hotel space in the same building to ensure that civic users are paying no more or less than their fair share for use
 of the space.  I would like to see that as part of the LOI included in this ordinance.
 
I think this can be a great project, and a fine addition to our City public spaces.  I simply hope that we can get very clear on how we will manage and use and charge for the space to insure that all  parties have appropriate expectations
 as we proceed.  Thanks to all for the great work moving this project forward.
