Business Commercial (BC) Zoning Code Amendment

This Hotline post is being made by City Staff in response to a City Council request to share information with the community regarding potential Council action to amend the zoning code as it pertains to the two "Business Commercial" zoning districts (BC-1 and BC-2).

On July 17, 2018, the Boulder City Council adopted on first reading an ordinance that would restrict the use of the ground floor of buildings in the Business Commercial (BC) zones to non-residential uses. Staff's understanding of council's rationale for this proposed change is that redevelopment of the ground floor in these zones as entirely residential would conflict with the BC zones' stated purpose, which is "to provide the community a wide range of retail and commercial uses" (BRC, Section 9-5-2(c)(2)(H)).  Based on this concern, city staff was instructed to prepare an ordinance that restricts the ground floor in these zones to non-residential uses. If approved by City Council, it would apply to new buildings or proposed conversions of ground floor spaces in the BC zones.

Planning Board is tentatively scheduled to review, conduct a public hearing, and make a recommendation to council on the draft ordinance on Sept. 6.  Second reading and a public hearing at City Council will be scheduled following the Planning Board and will likely include a discussion of amendments that would adjust the reach and effect of the ordinance.  Property owners and other stakeholders are encouraged to comment on the proposed ordinance by attending the Planning Board and/or City Council hearings or by conveying comments to the Planning Board at boulderplanningboard at bouldercolorado.gov<mailto:boulderplanningboard at bouldercolorado.gov> or City Council at council at bouldercolorado.gov<mailto:council at bouldercolorado.gov>.
