[BoulderCouncilHotline] Update on Hogan Pancost hearing tomorrow night

The Council Agenda Committee (CAC) discussed managing the Oct. 10th City Council meeting for the Hogan Pancost annexation application.  The attached agenda reflects the requested CAC changes including but not limited to allowing a 10-minute presentation of the Southeast Boulder Neighborhood Association (SEBNA) immediately following the applicant's presentation. The SEBNA presentation would include topics other than the flood, wetlands and groundwater topics, which will be discussed in the 'environmental considerations' portion.

The public hearing is scheduled to occur on October 10th.  The state Municipal Annexation Act allows the council to "continue the hearing to another date without additional notice if the volume of material to be received cannot be presented within the available time for any given session; except that no session of a hearing shall be so continued unless at least one hour of testimony has been heard." § 31-12-108(3), C.R.S.

Testimony will be taken during the general public hearing for annexation (which will follow the presentation of environmental considerations) and be open at least one hour on Oct. 10th.  If the public hearing takes less than an hour, it will closed on Oct. 10th.  If the testimony goes beyond one hour, the council will have the ability to continue the public hearing and deliberations to another meeting.

If this occurs, given the amount of information that will be put in the record, it is expected that City Council will continue the hearing to Oct. 17th.   If the matter is continued to the Oct. 17th meeting, any person that was not heard on the October 10th hearing that signed up and anyone that signs up on October 17th can sign up to speak before the public hearing is officially closed.

An interested person may only speak once to council on the project during the presentation and public hearings for this application.

For your information, councilmember Young has also proposed starting the public hearing tomorrow night at the beginning of the meeting, which would require a vote of council to suspend the rules of council procedure.

The approach discussed above allows interested persons to sign up tomorrow night (again, at least one hour of speakers would be necessary tomorrow night to meet the one hour state requirement to permit a continuation of the matter) and others to sign up on Oct. 17th to speak at the continued public hearing.
