Dear Council Members, 
 
At the Council Agenda Committee meeting yesterday, Mayor Appelbaum raised some questions regarding the Information Packet item on the flood related annexation offer.  Below please find responses.
 
1.      
How many properties would not be required to construct sidewalks, and wouldn’t this result in additional costs to the city in the future?

The standard city street section includes sidewalks, curb and gutter, and streetlights.  The Githens neighborhood and Old Tale Rd neighborhood are the only two areas of those included in the proposal  that
 would be offered the variation from the standard street section.  The remaining properties front an existing city street.  The Githens and Old Tale Road neighborhood characteristics are consistent with a rural-type residential street provided in the city’s
 Design and Construction Standards.  This approach is consistent with previous annexations in rural large lot areas like Gapter Rd, and with BVCP policy 1.24 Annexation, which states in subsection c): “Annexation of existing substantially developed areas will
 be offered in a manner and on terms and conditions that respect existing lifestyles and densities.  The city will expect these areas to be brought to city standards only where necessary to protect the health and safety of the subject area or of the city.”
 
2.      
How many properties have additional development potential and would the proposal provide adequate community benefit?
Approximately 25-30 of the 160 properties included in this flood-related annexation proposal have additional development potential.  The proposal for these properties is consistent with recent practice
 on annexations, and the Guidelines for Annexation Agreements, by requiring 2 times the affordable housing cash-in-lieu payment at the time of the additional residential development.  Through the annexation agreement, the city will require community benefit
 per BVCP policies 1.24 Annexation and 1.30 Growth to Pay Fair Share of New Facility Costs.
