I appreciate the additional clarification and I have added this to the recommendation page.  I appreciate the participation of CCI and CML in the Stakeholder process as well as the Governor’s Taskforce.  I believe the input from your organization

Jan and Thom:
Colorado Counties, Inc (CCI) wishes to supplement its comments submitted in conjunction with the Colorado Municipal League earlier this week to the COGCC setback stakeholder group.

First we would like to clarify that the CCI board has not formally reviewed for itself the available science on the public health impacts of different proposed setbacks and the board has not adopted a position on appropriate minimum statewide
 setbacks required in order to protect public health. 
However, as noted in the local government presentation to the stakeholder group, and touched upon in the submitted comments, CCI strongly supports local control. Any statewide rule should preserve a local government's ability to negotiate
 with interested parties setbacks beyond the statewide minimums that are appropriate for a defined area and for a specific well or group of wells, and to adopt local regulations governing setbacks.   CCI recognizes that local governments are required to balance
 a variety of interests when planning for development of any kind within their boundaries, including oil and gas development, and should be able to negotiate setbacks that take into account air and water quality impacts, environmental protections, transportation
 impacts, surface rights, public health, impacts on nearby residents and the circumstances of a particular parcel, in addition to protection of mineral interests.  CCI believes that the balancing of land use interests that are local responsibilities is best
 achieved at the local level.
