Dear Council Members:

City Council will consider first reading of an ordinance on Tuesday, June 19th to amend the Subdivision regulations by removing the requirement for private utility company signatures on final subdivision plats. The memorandum on this item has been circulated to the council in the agenda packet for the June 19th meeting. However, at the time of memo preparation, Planning Board had not yet reviewed and considered the proposal. This email is meant to serve as an update in light of Planning Board's review of the ordinance on Thursday, June 14th.

Planning Board unanimously recommended to City Council approval of the ordinance with the following motion:

On a motion by M. Young, seconded by A. Brockett, the Planning Board approved  6-0, (B. Bowen absent) recommend to the City Council an ordinance that a. eliminates the utility signature requirements on final subdivision plats and creates a new requirement that evidence be provided at time of final plat submittal that utility companies have reviewed the proposed subdivision plat and have acknowledged that services can be adequately provided for each lot of the subdivision and b. relocates from 9-12-10(a) to 9-12-8(c), B.R.C. 1981 the requirement that agreements with ditch companies be included with the final plat, if needed.

Staff will be present at the June 19th City Council meeting should there be any first reading questions.
