Unfortunately I'm not able to attend Tuesday night's council meeting as I'm on vacation with my family in the mountains in a place with very limited internet access. I wanted to offer a few thoughts for council's consideration in my absence.</div> <div style="font-family: Calibri, Arial, Helvetica, sans-serif; font-size: 12pt; color: rgb(0, 0, 0);"> <br> </div> <div style="font-family: Calibri, Arial, Helvetica, sans-serif; font-size: 12pt; color: rgb(0, 0, 0);"> <b>Ordinance 8393 regarding Hemp Licensing</b></div> <div style="font-family: Calibri, Arial, Helvetica, sans-serif; font-size: 12pt; color: rgb(0, 0, 0);"> <br> </div> <div style="font-family: Calibri, Arial, Helvetica, sans-serif; font-size: 12pt; color: rgb(0, 0, 0);"> I had several concerns about the ordinance as originally written. I'd like to thank Kathy Haddock and Tom Carr for having a meeting with me to discuss those concerns, and to change the ordinance in the staff recommendation to resolve several of them, including removing the requirement for background checks and adding additional time to respond to inquiries from city officials. I have two further changes that I would like council to consider making, which staff has included as potential amendments in Attachment B:</div> <div style="font-family: Calibri, Arial, Helvetica, sans-serif; font-size: 12pt; color: rgb(0, 0, 0);"> <br> </div> <div style="font-family: Calibri, Arial, Helvetica, sans-serif; font-size: 12pt; color: rgb(0, 0, 0);"> <ol> <li>Change to the separation requirements. Currently, no more than 3 marijuana businesses may be located within 500 feet of each other. The ordinance as proposed changes that requirement so that no more than 3 cannabis businesses (including hemp and marijuana) can be located within 500 feet of each other. Given that there are already a number of hemp businesses operating in the city, this may well create a situation where established marijuana businesses that have been compliant with the 500 foot separation for marijuana businesses would now be in violation of the 500 foot separation since it would now include hemp and marijuana businesses, which could cause them significant problems if they need to re-apply for a license or in other changes to their business situation. I recommend instead that the 500 foot requirements be separate for hemp and marijuana businesses, so that hemp businesses only count against other hemp businesses and marijuana businesses only count against other marijuana businesses.</li><li>Allow a grace period for license renewals. As written, the ordinance requires a hemp business to apply to renew their license before the expiration of that license. If they do not do so, the license becomes invalid, they lose the ability to renew, and they have to apply for a brand new license. If the license rules have changed since they first obtained their license in ways they now are unable to comply with, they might need to close the business simply for missing the deadline by a few days. Instead, I propose a 30 day grace period for license renewal, subject to a late fee.</li></ol> <div><b>Ordinance 8398 regarding Dockless Bike Sharing</b></div> </div> <div> <div style="font-family: Calibri, Arial, Helvetica, sans-serif; font-size: 12pt; color: rgb(0, 0, 0);"> <br> </div> <div id="Signature"> <div></div> <div id="divtagdefaultwrapper" dir="ltr" style="color:rgb(0,0,0); background-color:rgb(255,255,255)"> <p style="font-family:Calibri,Arial,Helvetica,sans-serif; font-size:12pt; margin-top:0px; margin-bottom:0px"> I had two requests regarding the Dockless Bike Sharing program that I wanted to put forward:</p> <div style="font-family:Calibri,Arial,Helvetica,sans-serif; font-size:12pt; margin-top:0px; margin-bottom:0px"> <ol> <li><span>Design the dynamic based cap function so that the fleet size does not go below the initial 500 bike allowance and also decrease the frequency by which staff assesses a decrease in overall fleet size based on an average of less than one ride per vehicle per day. </span></li><li><span>Ensure that community members who qualify for the low-income/affordability program are not assessed the $.15 fee per ride taken. </span></li></ol> <div><span>I sent those to staff last week and they have already agreed to incorporate those changes into the program.
