[BoulderCouncilHotline] Non-Designated Demolition Review (Historic Preservation)

Dear Council and Hotline Followers,

At the request of CAC, this email is to clarify the demolition review process for non-designated buildings over 50 years old.

Levels of Review
The historic preservation program reviews all demolition permit applications for buildings over 50 years old that are not in a historic district or individually landmarked. The purpose of the review is to prevent the loss of buildings that may have architectural or historic significance. There are three levels of review:


  *   Administrative: Historic Preservation staff reviews applications for buildings constructed after 1940 and accessory buildings over 50 years old.
  *   Landmarks Design Review Committee (LDRC): The LDRC, composed of two Landmarks Board members and one staff member, reviews applications for primary buildings constructed before 1940.
  *   Landmarks Board: If the property is found to be potentially eligible for landmark designation, the application is referred to the Landmarks Board for review in a public hearing.

For applications review by the full Landmarks Board, the Landmarks Board has three options:

  *   Issue the demolition permit.
  *   Initiate landmark designation.
  *   Place a stay of up to 180 days on the application.

The purpose of a stay is to provide time to consider alternatives to demolition. During a stay, staff and two Landmarks Board members typically meet with the applicant and/or owner to discuss alternatives - could the building be preserved and incorporated into the redevelopment of the site? If the Landmarks Board does not take action during the stay (either issue the demolition permit or initiate landmark designation) the demolition permit will automatically issue.


City Council's Role
Unlike the review of Landmark Alteration Certificate or Landmark Designation applications, the City Council does not have a role in the review of non-designated demolition permits. If a Landmark Designation Application is submitted over the owner's objection during the course of the demolition process, the City Council would review the application and ultimately make the decision of whether or not to landmark the property.

Owner vs. Applicant
A potential buyer can submit a demolition permit application if they have property owner's permission. In the case of 2122 Goss Circle, the applicant is the potential buyer, and has submitted a letter from the owners providing written consent to submit a demolition permit application.
