Subject: Questions on Source of Income

Hi Tom,

The following questions about the ordinance came up in speaking with a couple of landlords who already accept vouchers:

  1.  Could a landlord be held liable for discrimination if the basis for not renting is that the unit is not a good fit? If yes, could there be some amendment to address contextual situations in a general manner?
  2.  If the voucher does not cover 100% of rent and the tenant fails to pay the balance, who would have the burden to follow-up on unpaid balance, would it be the issuer of the voucher (BHP, BCH) or the landlord?
  3.  If a voucher holder turns out to be a destructive tenant, who would have the burden for eviction, would it be the issuer of the voucher (BHP, BCH) or the landlord?

Here are a couple of their comments:

  1.  The process of signing up to accept the voucher was easy.
  2.  We loved having the tenants and the regularity of their rent payments.
  3.  Many of the landlord concerns with respect to history as a tenant can be addressed through credit checks.

Also, it would be helpful if you could provide a description of the process a landlord must undergo in order to accept vouchers at tonight’s presentation.
