Dear Councilmembers,

CAC members asked that the following information, and attached summary of the process to date, be prepared in anticipation of tonight's discussion about the rezoning request and options for considering a Boulder Valley Land Use Map change for 3303 Broadway.

The application before the city council for first reading is for a rezoning.  In Colorado, the rezoning of an individual property is quasi-judicial in nature.  The applicant is entitled to a hearing.  The hearing is scheduled for January 17, 2017.  There is also a legislative component to rezoning applications that requires the passage of an ordinance.    The typical council practice is to hold the public hearing at the second reading.   The passage of the ordinance on first reading is a formality that will simply get the city to the point where it would normally consider the request at a public hearing.

The present staff and planning board recommendation is based upon the premise that a Boulder Valley Comprehensive Plan Land Use Map change has not been approved.  Members of the CAC requested that the staff describe the manners in which, going forward, the issue of the BVCP land use map changes can be considered.  Within the annexed portions of the city, land use map changes require the approval of both the planning board and the city council.

Land use map changes could be initiated in any of the following manners.


  *   A BVCP land use map change can be considered as part of the five-year update.  The process for initiating requests from property owners and members of the public has been completed.   The Planning Board and City Council will have the opportunity to discuss changes to the land use map they would like considered at the Jan 24 BVCP study session.  There is still the opportunity to consider this property, potentially in combination with other nearby properties, as part of this update.


  *   An applicant can submit a new request or proposal for a land use designation change as part of a new development review application.


  *   The City Council could consider the same request for a land use map change that the planning board considered.   If the council would like to consider that application, it should let the staff know so that it can prepare materials for the January 17, meeting.   If Council approves a request, council could ask the Planning Board to reconsider  the request.  If the proposed change is approved by the Planning Board and City Council, the Board and Council could consider a zoning request that would be consistent with the land use map request.
