Dear Council Members,

The City will not bring forward ballot measures for the campaign finance reform for the 2017 ballot this summer.  The U.S. Supreme Court decided Citizens United v. FCC in 2010.  This case dealt with regulation of campaign spending by organizations. The United States Supreme Court held that freedom of speech prohibits government from restricting independent political expenditures by nonprofit corporations, for-profit corporations, labor unions and other associations.

The case law interpreting and implementing this decision is both complicated and continuing to evolve.  We are learning more with each decision regarding the authority of local governments to regulate in this area of free speech.  We will continue to monitor the developments in this area.

We look forward to addressing these issues in the context of amending the people's ordinance or at a future election.   I am happy to answer any questions that you may have on this matter.
