Dear City Council members,
 
Based on recent discussions relative to new land use code regulations and 500-foot rule, staff has drafted alternative ordinance language for consideration this evening. The two ordinances are attached to this
 message for your review.

 
The proposed regulations would apply specifically to University Hill and would:
 
·        
Eliminate the Neighborhood Pub or Bistro land use.
·        
Require new restaurants to meet the 50% food percentage requirement.
·        
Require all new establishments to close at 11pm.

The second ordinance would alter the 500-foot rule to permit Beer and Wine liquor licenses in addition to Hotel-Restaurant liquor licenses.
 
The alternative code changes would be adapted to the existing land use code and would dismiss nearly all the other proposed changes (e.g., land use definitions, citywide application of new criteria) previously
 contained within Ordinance 7938. The proposed changes within the attached alternative ordinance would also permit restaurants to operate with unlimited hours on the Hill as conditional uses (staff level review; neighborhood meeting and management plan requirement,
 no call up) IF the establishment did not operate with a liquor license. Because the proposed changes have been adapted to the existing code, restaurants, brewpubs and taverns would continue to be regulated similarly and thus, brewpubs and taverns
 could be possible on the Hill, but only if they were to hold the permitted liquor license type. Again, all establishments would be required to close at 11pm. Staff is also retaining the 4,000 square foot maximum establishment size that exists on the Hill per
 current zoning. It should also be noted that with a required 11pm close, the requirement of any future Use Reviews for
new establishments would be eliminated.
 
Other changes in the proposed ordinance are:
 
·        
Updating references from ‘restaurant and taverns’ in the code to ‘restaurants, brewpubs and taverns.’ Brewpubs was added to the code several years ago and while the reference was updated
 in the Use Table, it was not updated in other parts of the code. This change would accomplish this.
·        
Proposed changes to Title 2 (as proposed in the previous version of Ordinance 7938) relative to trash clean up have been retained.
·        
Proposed changes to the land use code relative to management plans (as proposed in the previous version of Ordinance 7938) have been retained as a code improvement.
 
Staff will leave a hard copy of the proposed alternative ordinances on the dais as well. We’d be happy to answer any questions via HOTLINE or at the hearing this evening.
